Lucien A. Morin, II Appointed Receiver in Archipel Capital Case

Judge Lewis Kaplan of the United States District Court for the Southern District of New York appointed Lucien A. Morin, II as receiver in the matter of Securities and Exchange Commission v. Gregory W. Gray, Jr., Archipel Capital LLC, BIM Management LP, et al. (15-CV 1465).  The lawsuit commenced by the SEC alleges that a purported venture capital fund manager in Buffalo improperly used money from three investment funds to pay fictitious returns to investors in a different fund.  The SEC obtained an emergency asset freeze to halt the alleged Ponzi-like scheme.  More information about this lawsuit, including a copy of the SEC's complaint is available on the SEC's website here.

As the Receiver for the corporate and relief defendants, Mr. Morin is charged with taking control, preserving certain assets in the case and interfacing with the affected investors.  Mr. Morin has set up a special email address (receiver@mccmlaw.com) for investors and counsel to contact him with any inquires or information.  

Mr. Morin is recognized as one of the preeminent attorneys in Western New York with respect to real estate and bankruptcy matters.  A frequent guest lecturer to bar association and realtor groups, he has also served on committees which have revised and improved the standard forms used by realtors and attorneys for residential real estate transactions.  Mr. Morin also maintains an active bankruptcy and workout practice, and serves as mediator for the United States District Court for the Western District of New York.

Named a 2012 Leader in Law by the Daily Record, Mr. Morin also has been chosen for inclusion on the 2014 Upstate New York Super Lawyers list, an honor reserved for those lawyers who have shown excellence in practice, and he has been named to the Best Lawyers in America in the areas of Bankruptcy and creditor-Debtor Rights.
